Holle Baby Food Class Action says JSG Babyfood does not disclose that its products contain toxic heavy metals

JSG Babyfood LLC misled consumers by marketing and selling Holle and Holle Organic branded baby food products containing toxic heavy metals, according to a new class action lawsuit.

Complainant Maria del Carmen Vasquez de Maldonado claims that JSG does not list heavy metals in the ingredients of its baby food products or warn consumers of their potential presence. She also claims that, rather than being honest about the presence of heavy metals in its baby food products, JSG instead advertises on its website that its baby foods are “lead-free” and have “no detectable traces of heavy metals”.

The presence of heavy metals in JSG’s baby food products was discovered in December after lab tests ordered by the New York State Attorney General’s office, according to the class action lawsuit.

Holle Baby Food Test shows all samples positive for heavy metals

Vasquez de Maldonado says all 18 Holle baby food samples tested came back positive for various levels of heavy metals, including cadmium, lead, mercury and arsenic.

“Not a single sample from the defendant contained heavy metals,” the class action lawsuit states.

In response to the findings, the New York State Attorney General’s Office told JSG that it should remove claims from its website and marketing materials that its products contain no heavy metals.

Vasquez de Maldonado claims that JSG knowingly misled consumers about the presence of heavy metals in its baby food products because he knew they would be “unwilling to purchase baby food containing toxic heavy metals.”

“Defendant capitalized on the desire of Plaintiff and Class Members to purchase safe and wholesome baby food for infants and children,” the class action says.

Vasquez de Maldonado alleges that JSG is guilty of breach of express warranty, fraudulent concealment and unjust enrichment and in violation of General business law in New York.

Plaintiff seeks a jury trial and seeks an injunction as well as monetary, statutory, treble and punitive damages for herself and all class members.

Vasquez de Maldonado wants to represent a national class and a New York underclass of consumers who have purchased Holle and Holle Organic brand baby food products contaminated with toxic heavy metals.

A similar class action lawsuit was filed in January against Plum Organics over the baby food maker’s allegations did not disclose that its products contained high levels of toxic heavy metals.
